Terms & Conditions

1. About these terms
These Terms & Conditions (“Terms”) apply to the Cauldron Castle mobile game, its website at cauldroncastle.com.au, and any related services (together, the “Game”). The Game is published by the Cauldron Castle team (“we”, “us”, “our”).
By downloading, installing or playing the Game you agree to these Terms. If you don't agree, please don't use the Game. Google Play's own terms also apply to your use of the Google Play Store and to payments made through it.
2. Who can play
The Game is designed for a general audience and is not directed at children under 13. If you are under 18, you must have your parent or guardian's permission to play and to make any purchase, and they should read these Terms with you. Parents and guardians are responsible for purchases made on devices and Google accounts they control. Google Play lets you require a password or approval for purchases.
3. Your account
- You may play as a guest or create an account with an email address. Your account lets you save progress and play across devices.
- Please give accurate information and keep your password secret. You're responsible for activity on your account unless it results from our failure to take reasonable care.
- Tell us promptly at cauldroncastle@outlook.com if you think someone else has accessed your account.
- Accounts are personal. You may not sell, transfer or share your account.
- You can ask us to delete your account at any time (see our Support page).
4. Your licence to play
We give you a personal, limited, non-exclusive, non-transferable, revocable licence to download and use the Game on devices you own or control, for your own non-commercial entertainment, in line with these Terms. We (and our licensors) keep all other rights in the Game.
5. Virtual items
The Game includes virtual currencies such as gems and coins, and other virtual items such as decorations, boosters and cosmetic items (“Virtual Items”). Some can be earned through play; some can be bought.
- No real-world value. Virtual Items have no monetary value. They can't be exchanged for cash, sold, transferred or traded, either inside or outside the Game, and they are not your property: you have a limited licence to use them within the Game.
- Virtual Items can only be used in the Game, and only on the account they were obtained on.
- We may change how Virtual Items work (for example their prices in gems or coins, or which items are available) to keep the Game fair and fun. We'll act reasonably and won't make changes designed to take away value you've paid for without a valid reason.
- Virtual Items may be lost if your account is deleted or terminated under section 13.
- Unauthorised trading, selling or buying of Virtual Items or accounts is not allowed.
Nothing in this section limits your rights under the Australian Consumer Law (see section 8).
6. Purchases
- All in-app purchases are made through Google Play and are subject to Google Play's terms and payment policies. We don't receive or store your payment card details.
- Prices are shown in the Game at the time of purchase, in your local currency as set by Google Play, and include any applicable taxes such as GST where required.
- Purchased Virtual Items are delivered to your account once Google Play confirms payment. If something doesn't arrive, see our Support page.
- Refunds for in-app purchases are requested through Google Play's refund process. Google decides refunds under its own policies, but this does not affect your rights under the Australian Consumer Law, and we will help where an item we supplied has a problem.
7. Moonlit Circle subscription
Moonlit Circle is an optional subscription that gives subscribers extra benefits in the Game, as described on the in-game subscription screen at the time you subscribe (currently: a second, bigger daily gift; regular unlimited-heart periods; free starter boosters on gift days; every Enchanted decor style free; and hearts that refill twice as fast).
- Billing and renewal. Moonlit Circle is billed through Google Play at the price and billing period shown before you confirm. It renews automatically at the end of each period unless you cancel before the renewal date.
- Cancelling. You can cancel at any time in the Google Play Store (Payments & subscriptions → Subscriptions). Deleting the Game or your account does not cancel your subscription. After cancelling, you keep your benefits until the end of the current paid period.
- Free trials. If a free trial is offered, you will be charged when it ends unless you cancel before then. We will tell you the trial length and the price that applies after it.
- Price changes. If the price changes, you will be notified in advance by Google Play and/or by us, and you can cancel before the new price applies.
- We may update Moonlit Circle benefits over time. If we make a change that significantly reduces the benefits, we will give you reasonable notice so you can cancel.
8. Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (“ACL”). For a major failure with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.
Nothing in these Terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by the ACL or any other law that cannot lawfully be excluded or limited. If you live outside Australia, you may also have mandatory consumer rights under the laws of your country, and these Terms don't affect them.
9. Acceptable use
Please help keep the castle cosy. When using the Game you must not:
- cheat, exploit bugs, or use hacks, bots, mods, scripts or any unauthorised software to gain an advantage;
- copy, modify, decompile, reverse-engineer or create derivative works of the Game, except to the extent the law allows despite this restriction;
- interfere with or disrupt the Game, its servers or networks, or try to access accounts or data that aren't yours;
- buy, sell or trade accounts or Virtual Items outside the Game;
- exploit purchase systems, including by making fraudulent purchases or chargebacks;
- impersonate anyone, or use offensive, hateful or misleading names or content (if the Game lets you name things);
- harass, threaten or abuse other people, including our support team;
- use the Game for any unlawful purpose or in breach of these Terms.
If you find a bug, please report it to us rather than exploiting it. Thank you!
10. Intellectual property
The Game, including its name, logo, artwork, characters, music, text, software and all Virtual Items, is owned by us or our licensors and protected by copyright, trade mark and other laws. You may share screenshots and videos of your own gameplay for non-commercial purposes (for example on social media), as long as you don't suggest you're officially connected to the Game.
If you send us ideas or feedback, you agree we may use them freely without paying you, though we may not be able to use every suggestion.
11. Third-party services & ads
The Game relies on third-party services such as Google Play, and may include analytics and advertising services (currently Google AdMob for optional rewarded videos). Optional rewarded ads may let you earn Virtual Items. Third-party services are governed by their own terms and privacy policies, and we're not responsible for third-party content or websites linked from the Game, except as required by law.
12. Changes to the game & availability
We're always improving the castle, so the Game will change over time through updates that add, change or remove content and features. You may need to install updates to keep playing. We aim to keep the Game available but can't promise it will always be uninterrupted or error-free (for example, during maintenance).
We may stop offering the Game in the future. If we do, we'll give at least 30 days' notice in the Game and/or on this website, stop selling Virtual Items and new subscriptions during that period, and deal with any remaining Moonlit Circle subscription periods and unused paid items in line with the ACL.
13. Suspension & termination
You can stop playing and delete your account at any time. We may suspend or close your account, or remove Virtual Items obtained improperly, if you seriously or repeatedly breach these Terms, act fraudulently, or if we're required to by law. Where reasonable, we'll warn you first and give you a chance to fix the issue. If we close your account without a valid reason, we will refund any unused paid Virtual Items and the unused part of any subscription. Sections that are meant to survive termination (such as sections 8, 10, 14 and 16) continue to apply.
14. Disclaimers & limitation of liability
Subject to section 8, and to the extent permitted by law:
- the Game is provided for entertainment and on an “as is” and “as available” basis, and we make no promises beyond those set out in these Terms or that can't be excluded by law;
- we are not liable for any loss that is not a reasonably foreseeable result of our breach of these Terms or our failure to take reasonable care;
- where our liability for failing to comply with a consumer guarantee can lawfully be limited, it is limited to supplying the services again or paying the cost of having them supplied again.
We are not responsible for losses caused by your own breach of these Terms, by problems with your device or internet connection, or by events outside our reasonable control.
15. Privacy
Our Privacy Policy explains what personal information we collect and how we use and protect it.
16. Governing law & disputes
These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts that can hear appeals from them. If you're a consumer living elsewhere, this doesn't take away any right you have to bring a claim in your local courts or under your local consumer laws.
If you have a problem, please contact us first. Most issues can be sorted out quickly and informally.
17. Changes to these terms
We may update these Terms from time to time, for example to reflect changes to the Game or the law. We'll post the updated Terms on this page with a new effective date and, for significant changes, let you know in the Game. If you keep playing after changes take effect, the updated Terms apply. If you don't agree with them, you can stop playing, cancel any subscription and delete your account.
